Instant Cash Terms and Conditions

Definitions

In these Conditions the following terms shall have the following meaning:-

Services means Layby, Buyback, Buy or sell.

Company or The Company means InstantCash Ltd.

Data Protection Legislation means all applicable privacy and data protection laws including the General Data Protection Regulation ((EU) 2016/679) and any applicable national implementing laws, regulations and secondary legislation in England and Wales relating to the processing of Personal Data and the privacy of electronic communications, as amended, replaced or updated from time to time, including the Privacy and Electronic Communications Directive (2002/58/EC) and the Privacy and Electronic Communications (EC Directive) Regulations 2003 (SI 2003/2426).

Data Subject means an individual who is the subject of Personal Data.

You or Your refers to You.

Scope of Terms and Conditions

These Conditions cover Your relationship with InstantCash Ltd and will come into force immediately when You purchase goods from us, sell goods to us or use one of our Buyback or Layby services.

Any typographical, clerical or other error or omission in any sales literature, quotation, marketing, pricelist, invoice or other documentation issued by InstantCash Ltd shall be subject to correction without any liability on its part.

Limitation of Liability of InstantCash Ltd

InstantCash Ltd excludes liability for:

• Any loss of data, corruption of data, hardware or software malfunction.
• Any financial consequences or indirect consequences You may suffer after using one of our services.
• InstantCash Ltd shall not be liable to you or be deemed in breach of these terms and conditions by reason of any delay in preforming its services, if the delay or failure was due to any cause beyond its reasonable control, including but not limited to:
• Act of God, explosion, flood, tempest, fire or accident.
• War or threat of war, sabotage, insurrection, civil disturbance or requisitions.
• Acts, restrictions, by-laws, prohibitions or measures of any kind on the governmental, parliamentary or local authority.
• Strikes, lockouts or other industrial actions or trade disputes (whether involving our employees or of a third party).
• Power or equipment failure (including system outages).
• InstantCash Ltd shall have no liability to You should its internal system suffer an outage, which may potentially cause delays in your ability to execute actions pertaining to existing contracts, open a new contract.

In the event of any liability falling on InstantCash Ltd, that has not been excluded its maximum liability for any one claim or for the total of all claims arising from any one act is the total amount you have paid within the last 3 months.

Data Protection Legislation

To the extent that InstantCash Ltd processes Personal Data disclosed by You, it warrants that:

• It will only use information as set out in the clause.
• It has appropriate security measures against unlawful or unauthorized processing of Personal Data and against the loss or corruption of personal data.
• It will not transfer or permit the transaction of Personal Data outside the EEA without Your prior written consent.

InstantCash Ltd shall follow appropriate back-up procedures for Personal Data. In the event of any loss or damage to Personal Data, InstantCash Ltd will revert to the latest backup. InstantCash Ltd shall not be responsible for any loss or alteration to data during this process.

InstantCash Ltd will hold personal information/Personal Data about You as set out in this clause and in InstantCash Ltd’ Privacy Policy. We use the information as follows:

• To provide You services.
• To make You aware of InstantCash Ltd’ services and other similar offers, unless You have notified us that you wish to opt out of receiving such information.
• For research purposes (in which Your Details will be anonymous).
• For business making decisions (in which Your Details will be anonymous).
• To deal with any disciplinary matters in respect to You.
• As otherwise permitted by the Data Protection Legislation.

You consent to InstantCash Ltd destroying or otherwise disposing of any of the Personal Data in its possession in accordance with GDPR (General Data Protection Regulation) unless the Provider receives, no later than ten days after the termination of this agreement, a written request for Your most recent customer Data, in which, InstantCash Ltd shall use appropriate measures to deliver the back-up to You within 30 days of the written request. You shall pay all reasonable expenses incurred by InstantCash in returning Customer Data.

Confidentiality

InstantCash Ltd will hold in confidence all confidential information received from You and will not divulge the confidential information to any person outside of the organization, unless required by law.

It is recorded that the following information, will, for the purpose of this agreement not be considered as confidential information:

• Information that is known to either of the parties prior to the date that it was received from the other party.
• Information known to be public or generally available to the public prior to the date that it was disclosed by either of the parties.
• Information which becomes known to the public or becomes generally available to the public after the date that it was disclosed by either of the parties.
• Information which either of the parties, in writing, authorizes the other to disclose.

Purchasing Goods from InstantCash Ltd

InstantCash Ltd provide You upon competition of a purchase a one-year warranty subject to the Warranty Section in this document.

InstantCash Ltd makes every reasonable effort to ensure that the items it purchases are not stolen. However, in the event that an item is later discovered to be stolen after it has been purchased by You from InstantCash Ltd, the company waives all liability.

Selling Goods to InstantCash Ltd

By selling goods to InstantCash Ltd You declare that the goods are Your own personal property, free of all encumbrances and can pass clear title.

You agree that once the goods have been sold to InstantCash Ltd that they no longer belong to You.

As a condition of the transaction, you also agree that in the event of any of the goods sold by You to InstantCash Ltd being seized, repossessed, or confiscated, to reimburse the transaction amount within 28 days.

You also agree that any statements You have made concerning the goods are true. InstantCash Ltd reserve the right to contact You and request a refund should the goods be deemed, faulty or different to the information supplied by You.

Buyback Services

By using our Buyback Services, You agree to sell us the goods for the total purchase price specified on Your contract.

You understand that, once the purchase price is paid to You, that InstantCash Ltd will become the owner of the goods and that they will no longer belong to You. You also agree that You will have no right to have the goods back unless You exercise the option to re-purchase them from InstantCash Ltd on the terms specified on Your contract.

As a condition of the transaction, you also agree that in the event of any of the goods sold by You to InstantCash Ltd being seized, repossessed, or confiscated, to reimburse the transaction amount within 28 days.

Layby Services

By using our Layby Services, You agree that InstantCash Ltd retains ownership of the goods until the full purchase price, as specified on Your Contract, has been paid in full by You.

You agree to pay a deposit and to make the remaining balance payments in either monthly or biweekly instalments over the payment terms stipulate on Your contract.

If You fail to pay the balance of the deposit or any minimum instalment by the due date, or if You choose to cancel Your Layby agreement at any time, the Layby will be cancelled and the goods will be forfeited.

A cancellation fee equal to 10% of the item’s selling price will be retained by InstantCash Ltd to cover administration, storage, and restocking costs. The remaining balance of any payments already made (after deduction of this cancellation fee) will be issued as Store Credit in accordance with the Store Credit terms.

InstantCash Ltd provide You upon completion of Your Layby a 90-day warranty (or such other warranty period stated in these Conditions), subject to the Warranty section of this document.

If an item is discovered to be stolen before Your Contract is completed, a refund equal in value to the amount previously paid by You will be issued in accordance with applicable law and consumer rights, which may be provided in Store Credit unless otherwise required by law.

Store Credit

For the purposes of these Conditions, “Store Credit” means any credit issued by InstantCash Ltd to a Customer account as a result of a transaction, cancellation, goodwill adjustment, refund conversion, or any other reason at the Company’s discretion.

Store Credit shall be subject to the following terms:

Store Credit can only be redeemed towards the purchase of goods in-store and cannot be used for online purchases or any remote transaction methods. Redemption is strictly limited to physical store locations operated by InstantCash Ltd.

Store Credit cannot be used towards buyback transactions.

Store Credit is issued to, and remains assigned to, the individual customer account under which it was originally created. It is strictly non-transferable and cannot be shared, gifted, sold, assigned, or otherwise transferred to any other person or customer account under any circumstances.

Any Store credit used in whole or in part, towards a purchase will be returned to You as Store Credit.

Store Credit is valid for a period of 12 months from the date of issue unless otherwise stated in writing by the Company. Upon expiry, any remaining balance shall be automatically forfeited without notice and shall no longer be redeemable or recoverable.

Store Credit has no cash value and cannot be exchanged, redeemed, or refunded for cash or any cash alternative, either in whole or in part.

The Company reserves the right to refuse the use of Store Credit where fraud, misuse, or breach of these Conditions is suspected. Store Credit usage is also subject to the Company’s right to amend or withdraw this scheme at any time, provided that any such change shall not unfairly affect Store Credit already issued in accordance with applicable law and statutory consumer rights.

Warranty

InstantCash Ltd, provide a 90-day warranty to You on completion of a Layby or purchase, providing you have the initial receipt of purchase and that the item presented is the original item.

Warranty excludes the following:

• Damage to the item, which was not present upon completion of purchase.
• Modification to the item.
• Customer changing their mind.
• Motor Vehicles

When a warranty claim is made InstantCash Ltd will either repair or replace the goods at its discretion. If the goods are no longer available InstantCash Ltd will provide a refund equal to the amount paid by You or substitute the item for another item of equal value.

InstantCash Ltd have the right to refuse, change or opt out of the warranty without any written warning, or notification to You. This clause does not affect your Statutory Rights as specified in the Statutory Rights section of this document.

Termination of Your Contract

InstantCash Ltd may terminate Your contract at any time by written notice in the event of any of the following:

• You breach any of these conditions or conditions specified in any documents or policies issued by InstantCash Ltd.
• You fail to pay any outstanding fees.
• You have given any false or misleading information to InstantCash Ltd, whether directly or indirectly.
• Any of the instances set out in the Physical or verbal abuse section of this document occur.

Should InstantCash Ltd terminate Your contract at any point it shall not be responsible to make any refund of any amount previously paid by You.

Physical or Verbal Abuse

InstantCash Ltd will not tolerate verbal or physical abuse of its employees or contractors.

Any such incident of abuse may lead to:

• A prevention in taking out additional contracts.
• In cases which InstantCash Ltd, at its sole discretion, considers to be serious or in repeat cases of physical or verbal abuse, Your existing Contracts may be terminated and You refused entry to any or all InstantCash Ltd premises.

InstantCash Ltd also reserve the right to report instances of verbal or physical abuse to crime prevention agencies and the police.

Miscellaneous

Failure by InstantCash Ltd to enforce strict compliance with these Conditions by You shall not be considered to be a waiver of any provisions of these Conditions. No waiver by InstantCash Ltd of any breach by You of these Conditions shall be considered as a waiver of any subsequent breach of the same or any other provision.

If any provision of these Conditions is invalid or unenforceable in whole or in part; the validity of the other provisions of these conditions and the remainder of the provision in question, shall not be affected.

The contract governed by these Conditions shall be governed by and interpreted in accordance with English Law and the parties agree to submit to the non-exclusive jurisdiction of the English Courts.

Statutory Rights

These conditions shall not affect Your statutory rights as a consumer.
